It would have been better if Government Legislators and the Inland Revenue had got their heads together.

But they didn’t... In 2010 we started working with a construction business.

As soon as we started working with the owners it was clear they faced a big issue – not of their making.

Some detailed legislation in the construction industry failed to comply with the Inland Revenue. This issue meant our client faced a substantial claim from 5 ex-employees trying to put this issue to their advantage.  

Our new client was listed to appear before an industrial tribunal as their ex-employees contended they should be employees as opposed to sub-contractors on the CIS scheme.   

Our challenge… if these ex-employees were successful in obtaining reclassification as employees there would be considerable costs to the company. Unpaid holiday pay would be payable and the threat of unlawful deductions from wages of employees hung over the directors of the business too.

The solution… The company faced a considerable legal bill if they enlisted the services of an employment lawyer.  But because of previous AD+ successes in challenging the Inland Revenue we set about creating the case for the business owners.

Betty Glancy from AD+ appeared before the judge representing the clients interest in each of the cases.  

Thankfully Betty prepared and performed brilliantly to help win 4 out of the 5 cases. The 4 were deemed to be sub-contracts and not employees the case could be taken no further.  

In the 5th case a settlement was reached out of court with little financial impact to the firm.

RESULT? A completely satisfied client who legitimately avoided substantial payouts and possible additional court action. They also avoided substantial employment lawyer costs.
